Q. 당사는 올해 12월 해외 공동기업 지분 50%을 매각하였습니다. 또한 12월말 이전에 유럽 및 중동지역에 해외지사를 설립할 예정입니다. 이 경우 12월말 이전 매각 또는 설립 법인(및 지사)도 해외현지기업명세서 및 해외영업소 설치현황표를 제출해야 하는지 궁금합니다.

한편, 해외현지기업고유번호가 청산되거나 발급되지 않았는데(외국환은행에 설립 등 신고는 완료하였으나, 통상적으로 매년 2월 전후 자동 부여 및 청산으로 안내받음), 12월 말 이전에 관할세무서로 별도 신청하여야 하는지도 궁금합니다.

A. 국제조세조정에 관한 법률 제58조에 따른 해외직접투자명세등은 사업연도 중 해외직접투자를 받은 외국법인의 주식 또는 출자지분을 양도하거나, 해외직접투자를 받은 외국법인이 청산하여 해외직접투자에 해당하지 아니하게 되는 경우에도 제출해야 하는 것으로, 질의에서 12월말 이전 매각하거나 설립하는 경우, 해외현지법인명세서 및 해외영업소설치현황표를 제출해야 합니다.

한편, 해외현지기업고유번호가 발급되지 않은 경우, 관할세무서로부터 발급받거나 999로 기재하여 신고하시면 될 것으로 사료됩니다.
